A new trial date has been set for a nurse accused of performing
illegal abortions at a Birmingham clinic that was shut down after
health officials found numerous violations.
Janet Onthank King will now be tried on Nov. 2. The 61-year-old's
trial on two counts of performing an abortion by a non-physician and
one count of falsifying medical records was originally set for January
2008.
Circuit Judge Gloria Bahakel ruled King's lawyers could
present evidence she was acting under authorization from the clinic's
physician, which state law allowed at the time.
Each misdemeanor charge is punishable by up to six months in prison for a first offense.
Summit
Medical Center was shut down in May 2006 after a woman delivered a
near-term stillborn baby six days after she was given an abortion drug.
